| Artistamps are issued by the imaginary postal authority of Ephemeria. Copyright is retained by Susan Reynolds. Purchase includes permission for use in personal artwork but no rights to sell or redistribute images. |
| 1.) It’s a Contract
YES, This constitutes a contract between you and Susan Reynolds. When you download or otherwise purchase one of our image files, whether it be from the Lulu.com/ephemeira download portal or elsewhere, the terms are the same. YES, because we created the images and retain the ownership of copyrights to them, we are able to license limited usage rights to you when you purchase and download. 2.) Royalty Free, but Copyright Retained YES, These images ARE Royalty free. This means that your purchase price covers the right to use them in many ways, as described below. You may use the image over again for different projects without having to gain permission each time. You can use them daily without ever getting permission, as long as you play by the rules. Although you are not expected to pay an additional fee each time you use them, they are NOT copyright free images and are not images in the public domain. 3.) Alteration and Reuse YES, You may alter the images, draw, stamp or emboss over them, layer other papers over them and generally have fun with in pretty much any way you choose, to suit your project. And you may print for personal use as many copies of each image file as you need for your creative uses. 4.) Art By You YES, you may use the images in artwork created by you. This includes using them in something you are creating as a gift, as part of a group project, or even if the finished work will be sold. YES, you may also use these images to create work that you will be submitting to be published in a magazine, or work that will be part of a book. 5.) Third Party Transfer No - On the other hand – Distribution of the images to a third party is a violation of the License Agreement. While it is fine to make something with an image (for example a Tag or Artist Trading Card) and give it away, your rights do not include making a copy of the image file to sell or even one to give to a friend for use in their work, or any use whatsoever. To be perfectly clear, you may not include these images in any materials intended for reuse, resale or distribution. This means that you can not print them out and use them as part of a collage packet to give to or sell to someone; nor can you have a rubber stamp made from the design, nor do anything that’s similar to these examples without violating the license agreement. If in doubt, please ask and we will be glad to clarify usage limitations. 6.) 50% Issue If our image, unaltered, constitutes the main illustration of your finished work, you must include the following information somewhere on the front or back of the piece: Image Copyright Susan Reynolds – Ephemeria.com. If a piece like this is published, the credit/copyright info must be published with it. For example if you make an edition of Artist Trading Cards using one or more of our images as the main art, adding layers of colored paper and a line of text; or if you use our image as a reference for a drawing which essentially looks like our image, those items are covered by this clause and the copyright notice must be shown. YES, all of these uses are allowed, but credit and copyright must be noted if our images ARE the main part of the art. On the other hand, if our image constitutes 50% or less of the finished work, this copyright notice is not necessary. The moral of the story: play with it until you have created something that is less than 50 percent ours, and more than 50 percent yours & you don’t have to deal with the notice. 7.) Registered User YES, when you purchase a file created by Susan Reynolds and download or receive the file via attachment, you do become a Registered User. When we get a report of a copyright violation it is easy to tell if the person using our image is a Registered User. We will also randomly check for ownership when we see our images used. 8.) YES, That’s it! The usage rights granted are very broad. And yes, we're nice and reasonable people, so.if you'd like to do something with the images and your intended use is honest and upright but somehow not covered here, you may still be able to get permission by contacting us and asking.
